New Law for Influencers in Spain

The Government has approved the Law for Influencers, a regulation that obliges content creators with incomes over 300,000 euros per year and more than one million followers on a social network to register with the State Registry of Audiovisual Providers within two months. The Minister for the Digital Transition, José Luis Escrivá, explained that the law seeks to ”homologate, in some aspects," these creators with other actors in the audiovisual field. It also applies to influencers who have published 24 or more videos in the last year.

Exceptions to the Law and Criticisms

Spanish content creators who reside outside the country, such as Georgina Rodríguez or The Grefg, are exempt from complying with this law, which has been criticized by the Communication Users Association as unfair to other creators.

Rules for Influencers and Penalties for Non-Compliance

The law states that influencers must follow strict rules regarding the protection of minors and advertising. This includes identifying sponsored posts and prohibiting the promotion of products such as tobacco, medicines and alcohol, as well as any content that may be harmful to minors. They must also indicate the minimum age for their content, according to the parameters of the Government and the National Commission of Markets and Competition (CNMC). Failure to comply with these rules may lead to fines from the State.
